CONNECTED SERVICES TERMS

1. Parties

Dietatec Oy ("Dietatec"), Business ID 2433421-6, Teollisuusneuvoksenkatu 4, 00880 Helsinki, Finland — manufacturer of Genier kettles and provider of connected services.

Customer — the organisation that owns or operates the Genier kettle and activates the WLAN function.

Authorized Platform Partner — a company with a platform agreement with Dietatec to distribute Genier kettles and connected services through their own distribution network. Current Authorized Platform Partners are listed at https://genier.com/authorized-platform-partners.

Distributor — a company that has purchased Genier kettles from Dietatec or an Authorized Platform Partner for resale.

Service Company — a company authorised by the Customer to service their equipment.

2. Scope

These terms govern the encrypted two-way data connection between the Genier kettle and Dietatec's cloud. They apply from the moment WLAN is activated and do not replace the General Terms of Sale.

3. Activation

WLAN is activated from the device menu. Confirming activation constitutes acceptance of these terms on behalf of the Customer's organisation. Acceptance is logged with the device serial number and timestamp. WLAN can be deactivated at any time without affecting core device functionality.

4. Data Connection

All data is transferred over an encrypted connection (SSH over WPA2), always initiated by the device.

The device sends to Dietatec's cloud:

  • Operational logs and fault data
  • HACCP process data per cooking program
  • Cooking program settings and configurations
  • Device settings and usage counters

The device can receive from Dietatec's cloud:

  • Software updates
  • Cooking programs and device configurations

On first connection, all historical data from commissioning is synchronised. Only Dietatec and parties authorised under Section 6 can send data or updates to the device.

5. Dietatec's Right to Use Data

Activating WLAN grants Dietatec a worldwide, perpetual, royalty-free licence to store and process device data for remote support, maintenance, product and service development, and customer-facing reporting. Dietatec may grant access to this data to contracted development and technology partners acting solely on Dietatec's behalf and bound by equivalent confidentiality obligations.

Cooking programs are the Customer's intellectual property. Dietatec may use cooking program parameter data in aggregated and anonymised form for development purposes only. Individual cooking programs are not reproduced or disclosed in identifiable form.

6. Data Access

The Customer owns their device data. Access is as follows:

Dietatec and its contracted partners have access to all device data for the purposes in Section 5.

Authorized Platform Partners have access to all data from devices they have supplied, including HACCP data and cooking program configurations, under confidentiality obligations equivalent to these terms.

Distributors have default access to technical data from devices they have supplied, including logs, fault data, HACCP data and usage counters. The Customer can remove or modify this access through Dietatec's online service portal.

Service Companies have access to technical data for devices assigned to them by the Customer, managed through the portal.

No other party has access unless explicitly granted by the Customer through the portal.

7. Confidentiality

All device data is treated as confidential by Dietatec and all parties with access under Section 6. Data is not sold or disclosed outside this structure.

8. Personal Data

Device data: The device is designed not to collect or transmit personal data. If the Customer's environment creates a link between device data and identifiable individuals, the Customer is responsible for assessing this under applicable data protection law.

Service registration: When registering for Dietatec's online service, users provide their name, business email address and company details. Name and business email address are personal data under GDPR (EU 2016/679) and are processed by Dietatec as data controller. Users are registered under their employer organisation. 9. Customer Rights — EU Data Act

The Customer may at any time request export, transfer to a third party, deletion or correction of their device data. Deletion following WLAN deactivation is confirmed within 30 days. Submit requests to info@genier.com.

10. Data Storage and Retention

Data is stored within the European Union. Data is retained for the operational lifetime of the device and a reasonable period thereafter. For specific retention information contact info@genier.com.

11. Changes

Dietatec may update these terms with 30 days notice for material changes. Material changes require fresh acceptance on the device. Current terms are always at https://genier.com/connected-service-terms.

12. Liability

Dietatec's liability is limited to direct damages caused by gross negligence or wilful misconduct. Dietatec is not liable for indirect or consequential damages from the use or unavailability of connected services.

13. Governing Law

Finnish law applies. Disputes are resolved first through negotiation, then at the District Court of Dietatec's registered domicile.
